1. Introduction

    2. These Terms become effective when you “Accept” them by clicking “Sign Up" on our website

    3. We may amend these Terms by notifying you in writing (including by email). Where you access the Hatch Platform after any changes to our Terms. This will amount to acceptance of the new Terms.

  2. What We Do

    1. We're here to level the playing field and allow you to discover opportunities that are the right fit for you based on your skills, transferable strengths, preferences, and motivations.

    2. Our services include:

      1. matching Job Seekers with direct employment opportunities with Employer Users through talent matching services (Direct Placement); and

      2. labour hire / on-hire opportunities where you are employed by Hatch and placed with a Host Organisation on an assignment basis (On-hire Employment).

    3. When you apply for a Role, Hatch assesses your application via our talent matching platform, which reduces bias through a structured and anonymised assessment and shortlisting methodology.

    4. We may also put you forward or recommend you for a Role with an Employer User or Host Organisation that is not advertised.

    5. Employer Users may also reach out to you regarding other Roles where you are part of an existing pool of applicants for the Employer User.

    6. While the Hatch Platform seeks to allow you to discover opportunities that are the right fit, we cannot guarantee that you will be matched in any Role or be successful in obtaining employment.

  3. What We Expect Of You

    1. We expect you to accurately showcase your skills, strengths, preferences and motivations through written and video questions.

    2. You must not, whether by any act or omission, mislead or deceive Hatch or any Employer User or Host Organisation.

  4. Privacy

    1. When using our products and services (including the Hatch Platform) you will be providing Personal Information to us. This includes, but is not limited to, when you create a profile and provide us with information, when we request information from you to support an application and when you use our systems.

    2. As a Job Seeker, the Personal Information you supply that is relevant to demonstrating your suitability for employment may be available at any time to any Employer User or Host Organisation that you have applied to assist in matching you with Roles.

    3. We are committed to meeting the standards for the protection of Personal Information as set out in the Privacy Act 1988 (Cth).

    4. For more information on how Personal Information is collected, used, shared and stored by Hatch please read our Privacy Policy.

    5. Our terms also require Employer Users and Host Organisations to comply with the Privacy Act 1988 (Cth) and maintain the confidentiality and privacy of information they are provided in respect of Job Seekers. We recommend you also refer to the applicable Privacy Policy for any Employer User or Host Organisation where you intend to apply for a position.

  5. Intellectual Property

    1. We own all Intellectual Property relating to the Hatch Platform and any Materials. You agree not to infringe any Intellectual Property rights of Hatch.

  6. Direct Placement - No Employment With Hatch

    1. Where our services are for Direct Placement, we do not act on behalf of Employer Users in the recruitment and selection for any Role and Hatch does not offer employment to any Job Seeker.

    2. If you decide to accept a position with an Employer User, any engagement will be directly between you and the Employer User. We do not employ or otherwise engage you.

    3. We recommend that you seek your own accounting, legal, financial or taxation advice as appropriate before accepting any offer of engagement from an Employer User.

    4. Nothing in these Terms will be deemed to create a partnership, employment relationship or relationship of agent between you and us in respect of Direct Employment services.

  7. On-Hire Employment

    1. If you are offered and accept On-hire Employment you will be employed directly with us and will be provided with a written contract of employment.

  8. Exclusions

    1. We will not be liable for any claims or loss arising directly or indirectly from the recruitment, selection or engagement in connection with the Hatch Platform by an Employer User.

    2. You acknowledge and agree that:

      1. we will not assume any liability for any interactions between Employer Users and you;

      2. we have not made and will not make any express or implied warranties as to our services; and

      3. we have not and will not make any commitments or representations on behalf of Employer Users or Host Organisations.

  9. Accounts and Passwords

    1. When you first use the Hatch Platform you will be required to create a username and password, or register with your third party account (e.g. Google Account). You are responsible for maintaining the confidentiality of your username and password at all times. You are also responsible for the activities occurring under your login.

    2. If you suspect or become aware of any unauthorised access to your account you must email us immediately at ask@hatch.team.

    3. You may change your password by following the instructions displayed on the log-in page.

  10. General

    1. These Terms will be governed by and construed in accordance with the laws of New South Wales and the laws of the Commonwealth. The parties agree to the exclusive jurisdiction of New South Wales and the Commonwealth.

Definitions

Employer User or Employer Users

means customers / clients who use Hatch to find Job Seekers for Direct Placements.

Hatch Platform

means Hatch’s talent matching platform used by you to find work and used by Employer Users and Host Organisations to find talent.

Host Organisation

means customers / clients who use Hatch’s On-Hire Employment services.

Intellectual Property

means all present and future rights conferred by statute, common law or equity in or in relation to copyright, trademarks, designs, patents, circuit layouts, business and domain names, inventions, trade secrets and confidential information, and other results of intellectual activity in the industrial, commercial, scientific, literary or artistic fields whether or not registrable, registered or patentable.

These rights include all rights in all applications to register these rights all renewals and extensions of these rights and all rights in the nature of these rights, such as Moral Rights.

Materials

means all works, documentation, ideas, concepts, designs, inventions, developments, improvements, systems or other material or information, created, made, discovered or supplied by Hatch in connection with its products and services.

Moral Rights

means rights of integrity of authorship, rights of attribution of authorship, rights not to have authorship falsely attributed and rights of a similar nature, that exist, or may come to exist, anywhere in the world in all Materials made or to be made by Hatch in connection its protects and services.

Personal Information

means information or an opinion whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion.

This may include name, educational background, work history, interests and other information where you are reasonably identifiable.

Posted Content

means any content created and displayed by an Employer User in connection to a Role.

Role

means any role (whether advertised or not) available with any Employer User or Host Organisation, including any role in which Hatch uses its anonymised talent matching technology to match Job Seekers with Employer Users or Host Organisations and / or any role where Hatch may put forward a Job Seeker to a Company User or Host Organisation.

This includes any role advertised on the Hatch Platform or any role advised by the Employer User through another source (e.g. LinkedIn or Seek) with a unique Hatch link embedded in the advertisement.

Us, our, we or Hatch

refers to Hatch People Pty Ltd

You, Your or Job Seeker

means you as the user of the Hatch Platform to look for work and/or you as a candidate for on-hire assignments with any Host Organisation.
