How does Hatch’s labour hire model work?

You can hire through Hatch using our labour hire model, meaning Hatch employs the person and hires them out to your business. This makes hiring simpler and faster for your business - here are a few things to know about it.

What is labour hire? ⚖️

Labour hire (also called "on-hiring") is a legally regulated arrangement where Hatch is the legal employer of record, and your business directs their day-to-day work.

  • Why it exists: this is what lets you skip employment admin like contracts, pay, and super, while still managing the person's work directly.

  • It's licensed, not automatic: businesses need a labour hire license to legally operate this way in Australia, and licensing is granted per state.

Why location matters, especially for remote roles 📍

Because labour hire licensing is state-based, where the person is physically located determines whether Hatch can legally employ them, not where your business is based.

  • Licensed states: Hatch is currently licensed to operate in NSW, QLD, WA, TAS, SA, VIC and NT.

  • Not yet licensed: we don't currently support placements in ACT and don't have a timeline for when we will.

  • Remote roles need extra care: a remote hire could be based anywhere in Australia, so before you proceed, confirm they're actually located in one of our licensed states, not just that your business is. If they're in ACT, we can't place them, regardless of where your office is.

How people get paid 💵

  • Pay rates: your hire’s pay rate depends on where they’ll work, whether they’re a student or graduate, their qualifications, and the type of role. Most standard student roles have an award rate of $33.71 with a charge rate $49.37 (excl. GST). You can use our pricing calculator to estimate your role’s specific pay rate and your total placement cost.

  • Overtime and weekends: hours outside 7am to 7pm Monday to Saturday as well as hours worked after 38 hours a week are paid at higher overtime rates, so factor that in if you need weekend or after-hours work. You can see a breakdown of these overtime rates on our pricing page.

  • Timesheets: your hire submits a timesheet weekly, you approve it in Xemplo by Tuesday close of business, and they’ll be paid fortnightly. Read more about how to approve timesheets here.

  • One invoice: you pay a single weekly invoice, we handle paying your hire directly.

Other restrictions to know ⚠️

  • Role type: the role must be genuine Intern, Contract, or Temporary work.

  • International hires: if your hire is on a student visa, they can't work more than 48 hours a fortnight during semester. See the most up to date rules here.

  • Weekend or after-hours work: only allowed if agreed with your hire directly, and paid at overtime rates.
