Acceptable Use Policy

Any defined term used but not defined in this Acceptable Use Policy has the meaning given in the Hatch Employer Terms of Use or the Hatch Customer Agreement.

  1. You and your End Users must only access and use the Platform:

    1. through the URL designated by us; and

    2. with valid User Accounts granted by us.

  2. You must not and must ensure that your End Users do not:

    1. use the Platform for any purpose that is not permitted by your agreement with us;

    2. infringe our or our licensors’ Intellectual Property Rights;

    3. decompile, decipher, disassemble, reverse engineer or otherwise decrypt the Platform except to the extent permitted by non-excludable laws;

    4. use the Platform to provide services to a third party or allow any third party to access or use the Platform in any way not authorised by us;

    5. integrate or interoperate the Platform with other software, hardware or data used or licensed by you without obtaining any necessary permits, consents or licences required;

    6. modify or create a derivative works from the Platform except as authorised by us;

    7. use the Platform in any way prohibited by law;

    8. copy the Platform, or frame, store, publish, transmit or distribute the Platform, in a manner that is inconsistent with this agreement;

    9. engages in systematic retrieval of data or other content from the Platform or any of its content to create or compile, directly or indirectly, a collection, compilation, or directory without our written permission by use of scrapers or other tools;

    10. require any Applicant to pay a fee, charge, cost or any money whatsoever in connection with the hiring process for any job advertised on the Platform (including to apply);

    11. release to the public any news release, advertising material, promotional material or any other form of publicity relating to us without our prior written approval;

    12. use or refer to the Platform in developing any goods or services that compete with the goods or services provided by us;

    13. use the Platform to try to gain unauthorised access to or disrupt any service, device, data, account or network, or in a way that could harm the Platform or impair anyone else’s use of them;

    14. breach or attempt to bypass any security measures of the Platform, including in relation to any penetration or security testing (or by authorising or directing anyone to do the same);

    15. remove, obscure or modify any trade marks, copyright notices or disclaimers as they appear in the Platform; or

    16. disrupt or interfere with the Platform.

  3. You must not and must ensure that End Users do not post or transmit in connection with the Platform any material that:

    1. you do not have the right to send, including proprietary material of any third party;

    2. consists of unsolicited messages, chain letters or unsolicited commercial e-mail;

    3. advocates illegal activity or discusses an intent to commit an illegal act;

    4. is abusive, vulgar, obscene, pornographic, or indecent;

    5. does not pertain directly to the Platform or the Services;

    6. threatens or abuses others, libels, defames, invades privacy, stalks, is obscene, pornographic, racist, abusive, harassing, malicious, threatening or offensive;

    7. seeks to exploit or harm children by exposing them to inappropriate content, asking for personally identifiable information or otherwise;

    8. infringes any intellectual property or other right of any entity or person, including violating anyone’s copyrights or trademarks or their rights of publicity;

    9. impersonates or misrepresents your connection to any other entity or person or otherwise manipulates headers or identifiers to disguise the origin of the content;

    10. advertises any commercial endeavour (e.g., offering for sale products or services) or otherwise engages in any commercial activity (e.g., conducting raffles or contests, displaying sponsorship banners, and/or soliciting goods or services) except as may be specifically authorised on the Platform;

    11. solicits funds, advertisers or sponsors;

    12. includes programs which contain viruses, worms and/or Trojan horses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications;

    13. disrupts the normal flow of dialogue, causes a screen to scroll faster than other users are able to type, or otherwise act in a way which affects the ability of other people to engage in real time activities via the Platform;

    14. includes MP3 format files;

    15. amounts to a “pyramid” or similar scheme;

    16. disobeys any policy or regulations established from time to time regarding use of the Platform or any networks connected to the Platform;

    17. engages in deep-linking, in-line linking, mirroring or framing of any content of the Platform without our prior express, written permission;

    18. violates the restrictions in any robot exclusion headers on the Platform or bypass or circumvent other measures employed to prevent or limit access to the Platform;

    19. takes any action that imposes, or may impose, in our sole discretion, an unreasonable or disproportionately large load on the Platform’s infrastructure;

    20. uses the Platform to engage in activities that violate any terms or conditions of any other network access provider or internet service provider;

    21. engages in any other activity deemed by us to be in conflict with the spirit or intent of the agreement; or

    22. contains hyper-links to other sites that contain content that falls within the descriptions set forth above;

  4. When placing advertisements on the Platform, you must comply with the following:

    1. You must, and must ensure that your End Users must, ensure all advertisements on the Platform comply with all applicable Laws, including (but not limited to):

      1. Competition and Consumer Act 2010 (Cth);

      2. Fair Trading Acts in all applicable States and Territories;

      3. Privacy Act 1988 (Cth) including the Australian Privacy Principles;

      4. Estate Agent Acts in all applicable States and Territories; and

      5. Human Rights and Equal Opportunity Commission Act 1986 (Cth);

      6. all anti-discrimination and equal opportunity legislation applicable in the State or Territory in which you do business; and

      7. Fair Work Act 2009 (Cth) and all employment related legislation and regulation applicable in the State or Territory in which you do business.

    2. All advertisements must not disregard or preclude Applications submitted via the Platform, including by wording to that effect within the advertisement itself.

    3. Each advertisement published on the Platform must only be in respect of genuine, paid employment opportunity that is current as at the time of posting the advertisement. We reserve the right to request any information from you that we deem necessary to verify that a genuine, paid employment opportunity exists.

    4. You must only advertise one Role per Slot on the Platform.
